Colten Sirio Found Guilty on Multiple Counts
Yesterday, a jury found Colten Sirio guilty of 10 counts ranging from kidnapping to child abuse following an incident that happened earlier this year.
On February 7th, 2024, Fort Collins Police Services officers responded to a call at City Park Avenue and West Elizabeth Street for a suspicious male walking with a woman pushing a stroller. Officers on the scene recognized the man as Colten Sirio from a “Be on the Lookout” or BOLO report for previous crimes and an active warrant.
Officers instructed Mr. Sirio that he was under arrest. He then took out a firearm and pointed at the female he was walking with. He yelled several statements at the officers and would not comply with their instructions all while holding the female victim at gunpoint.
As he continued to walk with a firearm aimed at the victim, an officer fired his weapon, striking Mr. Sirio in the shoulder. Mr. Sirio was arrested and the 8th Judicial District’s Critical Incident Response Team or CIRT protocol was activated. The female victim and the children in the stroller were unharmed from the incident.
The CIRT team, led by the Larimer County Sheriff’s Office, completed their investigation and presented it to the District Attorney’s Office. The District Attorney’s Office found that the officer was justified in his actions.
The trial for Mr. Sirio began on December 10th and was led by Domestic Violence Unit prosecutor, Lara Maierhofe and Special Victims Unit prosecutor, Dave Cheval. They presented evidence including videos of the incident, phone calls from the victim, and the handgun itself.
Colten Sirio was found guilty of the following and could be facing the following sentence. Additionally, due to Mr. Sirio being on parole at the time of the offense, these penalties fall into the aggravated range.
- (3) First Degree Kidnapping (F2)
- Crime of Violence: Mandatory 16 - 48 years DOC for each charge, mandatory consecutive
- Up to $1,000,000 fine for each charge
- (3) Second Degree Kidnapping (F3)
- Crime of Violence: Mandatory 8 - 24 years DOC for each charge, mandatory consecutive
- Up to $750,000 fine for each charge
The total mandatory minimum will be 72 years in the Department of Corrections, with a maximum of 216 years.

- Reckless Endangerment (M2)
- Up to 120 days in jail
- Up to $750 fine (2)
- (2) Child Abuse (M2)
- Up to 120 days in jail

Sentencing for Mr. Sirio will take place on Feb. 3rd, at 3:30 p.m. in Courtroom 3B.
