On February 3rd, Colten Sirio was sentenced to 48 years in the Department of Corrections after a jury found him guilty of:

-(3) First Degree Kidnapping (F2)
-(3) Second Degree Kidnapping (F3)
-Menacing (F5)
-Reckless Endangerment (M2)
-(2) Child Abuse (M2)

The prosecution secured this conviction when following all the evidence presented, Mr. Sirio was found guilty of all charges in December of 2024. The full details of Mr. Sirio’s crimes can be found below.

The prosecution team argued for a 72-year sentence in the Department of Corrections, by having each First and Second Degree Kidnapping count run consecutively. Ultimately the Court sentenced the top three counts, First Degree Kidnapping, to be run consecutively, for a total of 48 years. All other felony charges were sentenced to run concurrently. The Court imposed no additional sentences on the misdemeanor convictions.

“I am proud of how hard our team worked to take a dangerous offender off the streets,” said District Attorney, Gordon McLaughlin. “Mr. Sirio put many lives at risk that day, and without a brave officer’s actions—it could have ended much differently. The collaborative efforts of our agencies in the CIRT process, help us to hold these individuals accountable and can let our community begin to move forward.”

“These types of incidents have a lasting impact on the victims involved as well as the officers who respond,” said FCPS Assistant Chief Frank Barrett, who currently oversees the Criminal Investigations Division. “No officer wants to use their duty weapon, but they come to work every day knowing that it may be a reality to help protect the community and themselves. On that day in February 2024, the quick and heroic actions of the officers involved certainly saved lives, and today’s sentencing hopefully provides a sense of resolution to everyone involved.”

Yesterday, a jury found Colten Sirio guilty of 10 counts ranging from kidnapping to child abuse following an incident that happened earlier this year.

On February 7th, 2024, Fort Collins Police Services officers responded to a call at City Park Avenue and West Elizabeth Street for a suspicious male walking with a woman pushing a stroller. Officers on the scene recognized the man as Colten Sirio from a “Be on the Lookout” or BOLO report for previous crimes and an active warrant.

Officers instructed Mr. Sirio that he was under arrest. He then took out a firearm and pointed at the female he was walking with. He yelled several statements at the officers and would not comply with their instructions all while holding the female victim at gunpoint.

As he continued to walk with a firearm aimed at the victim, an officer fired his weapon, striking Mr. Sirio in the shoulder. Mr. Sirio was arrested and the 8th Judicial District’s Critical Incident Response Team or CIRT protocol was activated. The female victim and the children in the stroller were unharmed from the incident.

The CIRT team, led by the Larimer County Sheriff’s Office, completed their investigation and presented it to the District Attorney’s Office. The District Attorney’s Office found that the officer was justified in his actions.

The trial for Mr. Sirio began on December 10th and was led by Domestic Violence Unit prosecutor, Lara Maierhofer and Special Victims Unit prosecutor, Dave Cheval. They presented evidence including videos of the incident, phone calls from the victim, and the handgun itself.

Colten Sirio was found guilty of the following and could be facing the following sentence. Additionally, due to Mr. Sirio being on parole at the time of the offense, these penalties fall into the aggravated range. 

(3) First Degree Kidnapping (F2) Crime of Violence: 
-Mandatory 16 - 48 years DOC for each charge, mandatory consecutive
-Up to $1,000,000 fine for each charge

(3) Second Degree Kidnapping (F3) Crime of Violence: 
-8 - 24 years DOC for each charge
-Up to $750,000 fine for each charge

(1) Menacing (F5):
-2-6 years in DOC
-Up to $100,000 fine

Reckless Endangerment (M2)
-Up to 120 days in jail
-Up to $750 fine (2)

(2) Child Abuse (M2)
-Up to 120 days in jail
-Up to $750 fine

Sentencing for Mr. Sirio will take place on Feb. 3rd, at 3:30 p.m. in Courtroom 3B.
